Bouchey fires her attorney.

Well folks I miss a day and people are checking the papers for my obituary. As some of you know, many things are going on behind the scenes and it is premature to write about them. But trust me Keith and crazy nurse Nancy are not going to be happy. To my local readers I have a few columns coming up as well. I think I will try to alternate them to keep everyone happy.
Today’s latest development is the shocking news that Barbara Bouchey unceremoniously fired her attorney Richard Croak{here}. Again I have not spoken to her or had any contact with her. But If I had, I would have told her. “Are you out of your fucking mind?” Let me explain this to you, if you think they will go easy on you, or you can cut some kind of deal with NXIVM you’re dumber than I fucking thought. I may not have learned much in life, but proper and aggressive legal representation is worth every penny. Playing nice in a courtroom will just get you eaten alive.
As I understand you think that by going pro se {advocating on one's own behalf before a court, rather than being represented by a lawyer} you might have a more compelling chapter for you upcoming book{ Money manager for a international cult} but when Coffey and Co. get done with you, there won’t even be a carcass to bury much less a women on a book tour.

Cloak irritated the shit out of them. So you get a call from your old friend and paramour Keith who tells you “trust me”. Well it’s your funeral Barb but don’t say you weren’t warned.

John, I think you got this a bit wrong said...

I don't think she's planning to go pro per.
I think she wants someone who will represent her better the her previous counsil.

Croak wasn't doing a good job for her.

I hope you're right.

I'm not going to make any comment on Barb, because it's too early to say whether she's going pro per, is going to cut a deal, or is going to get new representation. However, just reading this post made me realize how the law in this country, although executed pretty damn good sometimes, still has its flaws, and NXIVM's repetitive dealings with it exemplifies the bad parts of it - finding legal loopholes, screwing people over, making money, etc. - and not its true purpose, which is executing justice and doing what's right. The hypocrisy of the inner circle of this supposedly "ethical" organization is simply astounding.

Sound Familiar?

The Church of Scientology has been involved in court disputes in several countries. In some cases, when the Church has initiated the dispute, question has been raised as to its motives.[1] The Church says that its use of the legal system is necessary to protect its intellectual property and its right to freedom of religion. Critics say that most of the Church's claims are designed to harass Suppressive Persons, people who impede the progress of the Scientology movement.[2][3][4]

According to a U.S. District Court Memorandum of Decision in 1993, Scientologists "have abused the federal court system by using it, inter alia, to destroy their opponents, rather than to resolve an actual dispute over trademark law or any other legal matter. This constitutes 'extraordinary, malicious, wanton, and oppressive conduct.' ... It is abundantly clear that plaintiffs sought to harass the individual defendants and destroy the church defendants through massive over-litigation and other highly questionable litigation tactics. The Special Master has never seen a more glaring example of bad faith litigation than this."[5]

Legal disputes initiated by Scientology often fall into one of the following categories:

* Religious discrimination cases, including recognition as a religious organization.
* Copyright infringement cases. Scientology's religious documents are copyrighted, and many are available only to members who pay for higher levels of courses and auditing.
* Libel and slander cases.

In the years since its inception, the Church of Scientology's lawsuits filed against newspapers, magazines, government agencies (including the United States tax collecting unit, the IRS), and individuals have numbered in the thousands. In 1991, Time magazine estimated that the Church spends an average of about $20 million per year on various legal actions,[6] and it is the exclusive client of several law firms.

She said from the beginning that Croak was the only lawyer who wasnt scared off by the prospect of being legally tortured--forever--b the Bronfman legal support $.

One of her dpeositions says she reluctantly is forced to use him. Sounds like her hunches were right.

Hopefully, she get competent representation now.

Croak's primary fault is that he tells it like it is - and doesn't really give a fuck if he pisses off Judge Let-Me-Think-It-Some-More Littlefield. This, of course, is the same judge that let VanFraud and company drag out Toni Natalie's NXIVM induced bankruptcy for more than 8 years.

Bouchey is more worried about protecting her image than bringing the cult down. And unlike some of the others who have taken on the NXIVM machine, she still believes that NXIVM's philosophy and teachings are sound and valuable.

This is a classic PTSD case.

Susan said...

I hope that Barbara finds someone to help with her case. It would appear that there are slim picking for attorney's in the Albany region. Maybe she should try outside of Albany. How far does judge Littlefield's district go?

Many attorney's have been hired by NXIVM in the past so they are all out.

From Barbara's quest for an attorney before hiring Croak, Many attorney's seem to not want to get into the "MIX" of what happens when you deal with NXIVM and their followers in a legal battle.

Let's face it Toni N. was in bankruptcy for 8+ years.

Only goes to show you there is not "CIVIL" in civil suits

The only ones who banks in bankruptcy are the attorney's and who children's college funds are filling up nicely.

Questions I have had for years are

If a person or groups spends so much time and so much money in legal battles what does this mean about them? Do we do what is important for us to do?

Is this the kind of thing they want to be in the world? "Be the Change you want to see in the world" Mahatma Gandhi

What if 50% of the world sue someone right now? Happy lawyers they would be? What does this mean to the tax payers who pay for the court system? Where would the world be? How does this move humanity forward?

What if Gandhi spent his time suing everyone who spoke out against him when he was working on changing the great things he changed? Would of he got the press behind him the way he did by being sue happy? Would he had the time to do the great things he did or would all his time be spent on the next legal brief?

Does the Delhi Lama spend time in court fighting people who don't agree with him and speak out against him. I haven't heard of such things.

Nelson Mandela spent many years in prison. When he got out what did he do? Did he spend his time to change things in his county for the better? Did he sue people who he believed harmed him?

Why is it that the people who are really making an positive impact on the world put their efforts into their quest and not in the courts?

What did Hitler do with his time? What was his focus? What did he want to change in the world? What did he do with people he didn't agree with him? How did he get some many people to do his deeds?

These are questions I ponder? What do you think?

The above post is my opinion and question I think about. There is nothing in this post that exposes any "trade secrets" of NXIVM. There are questions that people have asked for hundreds of years. (Google them if you don't believe me).

No child labor laws were broken in the writing of this post and no animals were harmed during this post. OK, my cat wanted to sleep in my desk chair and I moved her to one of her many sleeping spots. She now wants to sue me for moving her from a warm bed to one that was cold. She is consider if she should hire an attorney or go pro-sey.

@ John - "So you get a call from your old friend and paramour Keith who tells you “trust me”." Are you saying BB consulted with KR re firing her attorney or is this just a joke?

Becca said...

I can't open the 'you're fired' doc. Does it say anything besides the obvious, like what BB's reasons are?

Some one should go to the DA and tell about all the cash followers pay when they do an exchange for a training and work as "staff".

They pay cash for their food and to use the cafe area. No checks accepted, no credit cards can be charged.

I bet a bunch of ex-nxivms would testify in court they paid cash. It would be easy to find out if nxivm claims the cash in their bank deposits.

They also run a cafe where people pay cash for food(not a licensed kitchen either)

This is the only way to take down these people is to report illegal things they are doing.

Anonymous said...

Anyone what to go to Vancouver BC?

I just heard a rumor that they are having the grand opening of their nxivm center on October 16‏th.

A special guest is going to be there the Not So Nice Nurse.

Location is a secret but I'm sure we can find out.

Sorry John the Canadian Border Patrol has your picture in every office. They have a warning that you are bad boy.

To Anonymous 2:16 PM:

Which DA do you think would be better: the one who let Kristin Keeffe work in his office and allowed her to share documents that were obtained via a grand jury subpoena with NXIVM's civil attorneys - or the one who is trying to help NXIVM, for the second time, to get one of their designated enemies indicted? DAs are politicians and like all politicians, they'll always help the ones who make the big donations.

@ 9:30 Am Anon - Very good point about cash. And that's how it was done when I needed to stay at anyone's house for the night. Always cash.

Becca said...

@ Susan - Were you at V-Week 2006, I think, where each morning someone would slip a little laminated card under our doors with a quote, usually KR's. One of the quotes he took credit for was the Gandhi quote you referenced above.

Maybe someone can send the "secret" study manual that is now available online everwhere.

The same one tht has their trade secrets that they ripped off scientology on every other world...

Someone should send it to the legal department at scientology.

See how Raniere likes a nice lawsuit against him by a real cult.

Anonymous said...

It seems like Raniere rips off almost everything. Scientology, ethical leader quotes, other people's money, other people's families, other people's women, other people's thoughts, other people's babies, rides from others, other people's time, other people's happiness and joy, etc. Has he ever had an original thought?

Anonymous said...

Unfortunately, most of what Raniere ripped off from $cientology comes only from the latter's low level materials and simple vocabulary, and not from the so-called advanced (OT Level) materials $cientology generally considers the confidential Drabble the so frequently sue over. The low level stuff Raniere has based most of his patent application is very elementary to the $cientology world.

True, $cientology considers their entire "technology" to be copyrighted scripture, but historically they have initiated very little litigation over the pre-OT documents. Of course $cientology charges much more for access to the nonsense contained in the OT levee (often hundreds of thousands of USD) than Raniere charges for his more simplistic dogma. Another significant difference is that almost all $cientology "training/counseling" is conducted in a one-on-one fashion as opposed to Raniere more group oriented approach. Also, Raniere has not adopted a religious angle so far.

An exception to this last distinction is NXIVM's "EM", which draws more parallels to $cientology auditing, albeit without the latter's use of their crude E-Meter, a type of very crude lie detector. No doubt this simplistic yet hi-tech looking device (which adherents pay several thousands for) lends a strong aura of credibility.

In my opinion Raniere likey has himself dabbled in at least the lower levels of Scientology and has perhaps at least read the upper OT levels (they can be found on the Internet). However, they are rather bizarre with all kinds of alien science fiction and claims of human bodies being inhabited by spiritual beings they call "body thetans" - really crazy stuff. As per $cientolog's warnings, you will go insane if you are exposed to these advanced OT materials, let alone be willing to shell out big bucks to learn these secrets.

Of course this poster has had no contact with anyone involved in any law suit involving NXIVM, any of it's followers or former followers. All the materials reference can be easily found using the magic of Google and an Internet connection. I encourage everyone to read $cientology' OT3 level for a very funny introduction to the evil space alien Xenu and a peek inside the mind of another insane "creator" of perhaps the largest human improvement scam in history. Makes Raniere look like a rank amateur.

Anonymous said...

Send it to Fox News host Greta VanSustern. Both she and her husband rank very high in Scientology.

Anonymous said...

$cientology usually brands anyone using or promoting unauthorized versions or adaptations of the "technical materials" ("TECH") as SQUIRRELS and typically brands them as "suppressives" (sound familiar). Under their well known FAIR GAME policy, suppressives can be lied to, cheated and otherwise harmed for their "crimes" against $cientology.

There is little doubt Raniere is on one of these suppressive lists.

Send it to that great investigative reporter Citizen Nancy. Or is she too busy writing about more pressing issues, like how to behave at a wedding or don't be mean to waitresses or interiews with people that really haven't done anything worth noticing?

Do YOU pay a COUNTY TAX for SAFETY DISPATCHER SERVICE where you live? If you DO, did your CITY decide to create their own CITY SAFETY DISPATCHER SERVICE to duplicate the COUNTY service... a CITY SERVICE paid by YOU through an additional CITY TAX? Just askin'. Thank you.

Tell us more about this brain wave thing NXIVM uses. $cientology lost at least one major legal battle with the FDA over their E-Meter and now must put a disclaimer label on every one of the devices.
