Breaking News; as my friends know both me and my wife’s cars were broken into last night as I was celebrating a long four day weekend. Some change was taken and our shit was tossed around but no harm done. My Chechen friends will be back up from the city tomorrow and the Sheriff will be once again cruising through the lot on a regular basis. I’m not sure what they are trying to prove, but the only real thing they have accomplished is to piss off me, my wife and some ex- Spetsnaz men. Yesterday’s morning session began with a noticeable buzz among several jury members who were surprised to see that Clare was no longer in the (court)house. Seems Clare couldn’t take being away from Keith and that coupled with the 90 degree heat was to much for the fair skinned Clare to take. Really kid get some sun that vampiress look is so 2010. Jimmy DelNegro has taken her place at the plaintiff’s table and by the time this trial is over I think he will have wished He never left Ester in Halfmoon. But I digress
Crockett called Barbara Gottlieb Website HERE to the stand and had her testify about what she found when she reviewed the Plyams’ accounting records. The reason for her very short and vague answers became very apparent when the Plyams’ attorney, Dennis Riley, started to cross-examine her.

Looking like she was going to vomit at any moment and sweating Gottlieb admitted that she had already been paid more than $1,000,000 for her “forensic accounting and analysis.”At that point the jury of average Jane’s and Joe’s was taken aback at that number. Sorry Crockett a Jury of your peers means average and average doesn’t mean a million+ fee. And then things got really interesting when Riley handed her a copy of her “Notes” from her first meeting with Crockett – and asked her to read the highlighted passages. This is when we get back to the surreal world of NXIVM.

When Gottlieb claimed that she couldn’t read her own writing (I AM NOT MAKING THIS SHIT UP!), Riley immediately had the “Notes” projected on a 6’x6’ screen so that everyone in the court room could read them. And there, in big bold letters, were the following statements (or words to that effect):
- Had sex with other thug’s wife
- Got threatened
- Decided to skip town
Gottlieb said that she thought the word “thug” might have really been “thing.” Absolutely no one believed her and a couple of the jurors had their mouths open when she finished testifying and hastily got off the witness stand.

All three of the statements in Gottlieb’s “Notes” were clear references to Jimmy I-don’t-even-know-my-own-middle-name DelNegro’s alleged encounter with the wife of William Diamond a/k/a Ken Thomas. He’s the “videographer” that Frank Parlato hired to record what he and the rest of his pals were up to LA.

Now this is where I make a serious disclaimer. William Diamond a/k/a Ken Thomas is a bit of a mystery. He had a website and then it was taken down. He was trying to “sell” his story and video{I’m not talking book deal here}. I have serious problems with people who want to sell their lives most traumatic events to the highest bidder .This much I believe is true. William Diamond a/k/a Ken Thomas had a young {and very, very young looking} Filipino 20 year old wife/girlfriend and mother to his child. Jimmy DelNegro took a special interest in teaching ethics to her Raniere style. She was either willingly boned or raped depending on whose account one believes.

- Clare testified that she had personally approved the hiring of attorneys and political consultants to get Frank Parlato, Yuri Plyam, and Rick Ross indicted in California. The people that were hired (and I’ll be publishing those names in a later posting) indicated that they would meet with the then California Attorney General, Jerry Brown – and Los Angeles Mayor Antonio Villaraigosa – to facilitate those indictments.

Comment: Holy shit! Looks like NXIVM was even able to get to Governor Moonbeam. No wonder Val was such a pushover.

- Clare acknowledged that she had approved the payment of invoices for James DelNegro’s company, J. Cricket LLC, to do “surveillance work” regarding the Plyams. According to an invoice from J. Cricket LLC that was admitted into evidence, it appears that this “surveillance work” included breaking into the Plyams’ garage – and stealing their garbage.

Comment: This sounds exactly like the scenario that NXIVM used on Rick Ross. Once again, Raniere shows that he has a very tiny repertoire (According to several sources, that’s not the only tiny thing that Raniere has).

- Clare acknowledged that the Trustees on her and Sara’s trusts had strongly encouraged them to get Keith Raniere and Nancy Salzman to sign Promissory Notes for the $65 million that Clare and Sara had provided to cover Raniere’s commodities trading losses. She also testified that no such Promissory Notes were ever signed.

Comment: Well, it’s nice to know that the adults at least made an attempt to close down the madness that is NXIVM. I wonder if Clare and Sara replaced the Trustees???

Well before I start there are two valuable lessons for the super attorneys here.

One; for you Crockett never ever put your client on the stand when they are a babbling incompetent idiot.

Raking in the money, living the high life and counting the billionaires the Bronfman’s introduced him too on both hands. But you clients got a real bad habit of turning on their friends Coffey. Someday Keith will grow bored or jealous or whatever his sick mind can think up, but in the end he will turn the Bronfman brats against you and some bigger, badder shyster from out of town will be feasting on your flesh. The following is a truthful retelling of what I heard in the courtroom, unless someone wants to buy me or provide a full transcript best I can do. Mindful of that, these are not a 100% complete quote.

· RE: Childhood

- Question: Were you raised in a very wealthy environment?

- Answer: My mother was raised in a middle class family – and she wanted Sara and me to be raised in that type of environment, rather than in a privileged environment like all of the other Bronfman children. So, when I was growing up, I had to take care of my own horses.

Comment: Sometimes life can be a real bitch!

- Answer: It was John Bartolomei who introduced us to Frank.

Comment: According to the story in today’s edition of The Buffalo News, it was actually Steve Pigeon who brought the Bronfman sisters and Parlato together. In addition to being a former chairman of the Erie County Democratic party, Pigeon also served as counsel to former New York State Senate Majority Leader Pedro Espada, Jr. (Yes, that Pedro Espada!). According to Wikipedia, Pigeon is currently a political consultant for the Buffalo, NY-based law firm of Underberg & Kessler, and Director of Tom Golisano’s “Responsible New York” political committee.HERE AGAIN

- Question: What did you and Sara hire Frank to do in terms of the Precision Development project?

- Answer: Frank Parlato was actually not working for Sara and me when he went to California to check up on the Precision Development project. He went there to look at the project – and decide if he wanted to invest in it.

- Follow-up Question: He went there as a potential investor?

- Answer: Yes.

- Follow-up Question: Well if he went there as a potential investor, why did you have to advance him $1 million to work on the project?

- Answer: Because he apparently didn’t want to invest his own money in the project.

Comment: Clare, for future reference, when you have to lend your investor the money he’s going to invest, he’s not an investor. He’s a borrower!

- Question: Did you say that you were grateful for the work that Frank did for you on the Precision Development project?

- Answer: Yes

- Follow-up Question: Then why did you try to get him indicted?

- Answer: Well, you can be grateful for one thing that someone does for you – but not like other things they’ve done.

Comment: According to the story in today’s edition of The Buffalo News, the Bronfmans have now served a formal notice on Parlato that they intend to sue him for fraud regarding the $1 million they paid him for his work on the L.A. development project (Hey, Jimmy D, that means probably means you’re next!). The notice was filed in New York State Supreme Court in Niagara County by William Savino (That’s the same guy that has been representing the Bronfmans in their ongoing claims against Barbara Bouchey and Joe OHara).

- Question:

- How much were you and Sara paying Frank Parlato for the work that he did for you before he went to Los Angeles to check up on the Precision Development project?

- Answer: About $30-$35 per hour.

- Follow-Up Question: But isn’t it true that you paid him $75,000/month during that same time period?

- Answer: Yes…but that’s because he was working a lot of hours.

Comment: OK, Clare, here’s some basic math for you to consider. If Johnny works at the factory every hour in every day for every day in a month that has 31 days, he’ll work a total of 744 hours (Don’t worry about the fact that Johnny might have to sleep every now and then, or take a crap, or whatever). And if you pay Johnny the high-end rate of $35 per hour, he’ll earn a total of $26,040 for that month.

· RE: Nancy Salzman

- Question: Why did Nancy Salzman have a 50% ownership interest in the Precision development project?

- Answer: She was Senior Advisor on the project. We hired her because of her expertise in psychodynamics.

Comment: According to Wikipedia, psychodynamics is “the systematized study and theory of the psychological forces that underlie human behavior, emphasizing the interplay between unconscious and conscious motivation.” In other words, Clare, it’s the study of brain farts.

- Question: How did Nancy’s share get reduced from 50% to 33%?

- Answer: When we signed the new “Operating Agreement” in January 2008, the ownership of the project was split up as follows: one-third to Sara and me; one-third to Nancy; and one-third to the Plyams.

- Follow-up Question: Why did Nancy transfer her one-third share of the project to you and Sara?

- Answer: Sara and I decided to do that because the project was so messed up – and we wanted to take over control of it.

- Follow-up Question: Did Nancy get anything for her one-third share of the project?

- Answer: No.

Comment: So Nancy gave up her 1/3 share of a $26 million dollar project and got nothing for it…Really? Wonder what the IRS thinks of this bullshit.

- Question: Why is Keith Raniere called “Vanguard”?

- Answer: It’s a title – and it means “founder and leader of a philosophical movement.” It’s like having the title of judge or lawyer.

Comment: I’m sure the judge loved this answer. C’mon Clare, even you couldn’t think this was a smart answer.

- Question: Did Vanguard use a formula in conjunction with his investments in the commodities markets?

- Answer: No.

Comment: Vanguard doesn’t need any formula to fuck off $65 million. He can do that all by himself. That’s what makes him Vanguard.

- Question: Did Vanguard explain the risks that were involved in his commodities investments?

- Answer: He said he was hedging his investments to insure that our losses would be minimal.

Comment: Thank God Vanguard was hedging his bets. Otherwise, you and Sara could have lost some big bucks. And wasn’t this Bernie Madoff’s explanation for why his investment strategy consistently produced annual profits of 12%-20%?

- Question: Did Vanguard tell you why he lost $65 million in the commodities market?

- Answer: Well, because he’s a scientist, he just shared his postulations with us.

- Follow-up Question: And what were those?

- Answer: He said it appeared that there a very wealthy Jew in New York City who was betting against his investments and controlling the market. At first he postulated that this could be my father – and later he postulated that it may have been Yuri Plyam.

Clare Bronfman cross-examined in LA trial; Crockett fucks up

Well this is just a little tease of the main post tomorrow night. I am in a secure location away from my laptop and will have a post tomorrow night. Crockett ‘s strategy to have her cross-examination postponed till Monday failed as the Judge denied his motion to let her be excused till Monday so he could bring up what he called a “very crucial witness” right after he ended his initial examination. The judge ordered her to stay and she was drilled for a couple hours and she didn’t do very well. I will have the whole story tomorrow night, but to give you a quick example of her behavior when asked if she had a privileged upbringing she commiserated directly to the jury that hers was a modest, even average childhood lamenting to the fact that she was even forced to care for her own group of pet horses.

- The rumor circulating throughout the courthouse is that Clare is going to leave town as soon as she finishes her testimony and cross-examination (She may try to skip the cross-examination part if she can). Although that will probably look weird to the jury, it’s undoubtedly going to better than letting the Plyams’ attorney call her back to the stand for more questioning.

- So with Clare not on the scene, who does that leave as the face of Precision Development LLC for the jury to watch throughout the trial? That would be the President of the company, Jimmy I-don’t-even-know-how–to-spell-Precision DelNegro. But for his first witness he called Natasha Plyam

- That brought us to Monday and you all know how my weekend went.

- Monday a pretty quiet day at the trial as CrockO’Shit spent most of the day trying to beat up Natasha Plyam. His aggressiveness doesn’t seem to be playing well with the jury which is predominately women. Even many of the male jurors seemed a little freaked out by his over-aggressiveness.
– and most of today objecting to evidence that the Plyams attorney was trying to get into the record. I lost count but I think that CrockO’Shit went at least 0-for-20 at one point in time today (Vegas has now lowered the odds to 50/50 on whether CrockO’Shit will blow a gasket before the trial is over).
- Thus far, CrockO’Shit seems to be focused on the fact that the Plyams were fronting the money that the real estate project needed because the Bronfman financing wasn’t coming in as fast as Raniere had promised. It’s not clear where he’s going with this “strategy” but if that’s his major argument, you got to wonder why the Bronfman brats even bothered bringing this lawsuit. Maybe they’re just trying to prove to Daddy that it was the Plyams rather than Vanguard that done them wrong.

- It looked like there were at least two local reporters in the courtroom yesterday. Both of them flashed media credentials on their way into the courthouse (I have to get me some of those).
